Mandate

The core functions assigned to the Office of the Deputy President in line with the Executive Order No. 2 of 2023 are: -

1.    Deputize the President in execution of the President’s functions in accordance with Article 147 of the Constitution;
2.    Chair Cabinet Committees;
3.    Oversee Implementation of Cabinet decisions across all Ministries and State Departments;
4.    Co-ordinate Inter-Governmental relations between the National Government and County Governments including Chairing the Inter-Governmental Budget and Economic Council (IBEC);
5.    Liaison with Constitutional Commissions and Independent Offices in matters that require intervention by the National Government including budgets, policy formulation and implementation of their recommendations;
6.    Co-ordinate the planning and supervise the implementation of development partners’ funded programs and projects;
7.    Oversee Public Sector Reforms; and
8.    Any other function as may be assigned by the President

Office of the Deputy President has various departments as shown below:

 

Forum for consultation and cooperation between the National Government and County Governments on matters of:

  1. Budgeting and financial management
  2. Borrowing, debt and grants management
  3. Integrated development and economic management
  4. Finance Policy, Legislation, and regulations
  5. Any other matter which the chairman in consultation with the members, agree ( s. 187(2) of PFMA & Art. 6(2) of CoK)

1. COMPOSITION OF IBEC AND CO-OPTED MEMBERS

  1. The Deputy President who shall be the Chairperson;
  2. The Cabinet Secretary responsible for matters of Finance and Economic Planning;
  3. Cabinet Secretary responsible for intergovernmental relations
  4. A representative of the Parliamentary Service Commission;
  5. A Representative of the Judicial Service Commission;
  6. The Chairperson of the Commission on Revenue Allocation or a person designated by the Chairperson;
  7. The Chairperson of the Council of County Governors;
  8. Every County Executive Committee member for finance (Section 187(1))

4. SUB COMMITTEE FUNCTIONS

1. Finance and Budget Committee
Chaired by the National Treasury and mandated to:
•    Recommend proposals on division of revenue and county revenue allocation, and the county Government additional allocation;
•    Agree on the schedule of cash disbursement to Counties and report on amount and timelines of disbursement;
•    Input on budget policy statement and budget review and outlook paper;
•    Analyze the stance of finance policy and make recommendations
•    Input on proposed finance policy
•    Consider policy research reports on finance matters

2. Financial Management Committee
Chaired by the office of the Controller of Budget and mandated to consider reports on financial management viz budget implementation, audits, financial monitoring and financial problems and related issues

3. Legal Committee
Chaired by the Office of the Deputy President and mandated to:
•    Recommend proposals on policy, legislation or regulations that have financial implication on the Counties;
•    Consider any matters referred by the Council that require legal input and where necessary to consult the Attorney General;
•    Recommend guidelines for County Government joint infrastructure investment;
•    Review any legislation that affects public finance in both levels of Government and to translate the other committee work into Policy when need arises

4.    Loans and Grants Committee
Chaired by the Commission on Revenue Allocation and mandated to:
•    Ascertain that borrowing is in line with the PFM Act, budget proposal and the borrowing framework
•    Provide input on proposed medium term debt management strategy
•    Consider reports on breaches of obligations or financial commitments and resultant recovery plans;
•    Ensure compliance with the requirements on grants management viz absorption cost implications of non-utilization, commitment fees, cost overrun, level of resource support, realization of support policies and programs to enhance economic development and challenges
•    Equalization fund (conditional grants as per Art. 204 of the Constitution for marginalized areas)

5.    Economic and Planning Committee
  Chaired by The State Department for Economic Planning and mandated to;
•    Assess the performance of the economy at the macroeconomic level and recommend appropriate interventions for efficiency and effectiveness;
•    Input on proposed macroeconomic policies
•    Facilitate the consultative process leading to the alignment of county development plans to national development priorities, and regional and international obligations
•    Coordinate tracking and reporting of implementation of policies, plans and programs, in line with national and county Monitoring & Evaluation systems;
•    Promote cooperation and collaboration to enhance efficiency and effectiveness in Public Investment Management (PIM) at national and county levels
•    Facilitate consultation, cooperation and coordination between the two levels of Government on issues of mutual interest through sector forums

6.    Continuous Improvement (Kaizen) Committee
Chaired by the Office of the Deputy President and mandated to:
•    Adapt and customize Kaizen into cultural context and employment system;
•    Facilitate the dissemination of Kaizen nationwide possibly with the assistance of development partners like Japan International Cooperation Agency (JICA);
•    Facilitate capacity building with assistance of development partners;
•    Facilitate enhancing leadership commitment for sustainability
•    Conduct benchmarking of other countries/ institutions to learn lessons from their efforts and experiences; and
•    Ensure utilization of local consultants and institutions committed to promoting Kaizen movement.

7.    Systems and ICT Committee
Chaired by the Judiciary and mandated to:
•    ensure effective use of ICTs in delivering the core mandate, in compliance with existing Policies, and adoption of International best practices for ICT Development and Innovation;
•    ensure utilization of ICT in improving Service Delivery;
•    Promote the Digital Economy; and
•    Facilitate systems development and improvement.

8.    Coordination Function
Led by the Special Secretary and mandated to:
•    Advise the chairperson on any matter touching on the Council’s mandate;
•    Coordinate IBEC and Committees’ works;
•    Collate reports for the Council’s agenda;
•    Take minutes and maintain records of Committees’ and Council’s proceedings;
•    Follow up on implementation of resolutions of the Council within the Mandate;
•    Deal with any emerging issues considered by the Council;
•    Disseminate information on decisions for implementation;
•    Publicize Council’s resolution's as necessary;
•    Engage with other intergovernmental agencies on pertinent issues;
•    Enlist the assistance of all organs of the state in facilitating the effective performance of the Council’s functions
•    Adherence to work plans and procurement plans
•    Represent Council at Joint Intergovernmental Technical Committee and Accountants Standards Board (s.100; s.193(1))
